Pat Quinn is getting hit with a nationwide backlash over his suggestion that the federal government bail out the state employees’ pension program. Critics have in the past several days pounced on the suggestion, made last year when Quinn, in announcing the state’s fiscal 2012, said part of Illinois' long-term effort to reduce the estimate $167 billion in under-funded liabilities would be to seek “a federal guarantee of the debt.” Among those leading the charge is Republican Sen. Jim DeMint. The South Carolina senator has joined the Illinois Policy Institute’s national “No Pension Bailout” campaign -- an effort to stop Congress from attempting to rescue failing state and municipal pension plans. “Our greatest concern is states will assume they can run their pension systems into bankruptcy and then turn to the federal government for bailout,” DeMint said Thursday. He also suggested the problem is the result of state legislators trying for decades to win over voters through pension promises based “on accounting methods that would put any business in jail.” The conservative policy group estimates the total amount of under-funded pension liabilities in states is at least $2.5 trillion, with Illinois leading the nation. The basic plan floated by Quinn would be for the federal government to rescue the pension program through buying the state’s bonds, which critics say are too financially risky to attract investors. Quinn said after announcing the budget that seeking the federal guarantee was only a precaution, then later called the related wording a “drafting error,” according the non-partisan Citizens Against Government Waste, which nevertheless gave the governor its September 2012 “Porker of the Month” award. The governor’s office could not be reached for comment this weekend. The Wall Street Journal’s editorial writers recently said: “Sooner or later, we knew it would come down to this since the Democrats who are running Illinois into the ground can’t bring themselves to oppose union demands.” In addition, an editorial Tuesday in the Chicago Tribune argued that saving Illinois will “start a stampede of demands for equal treatment from other financially troubled states” with public pension debts ranging from $1 trillion to $25 trillion.

Ricardo Pimentel + Express-News columnist + September 30, 2012 +++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Onward to the debates. +++++++++++++++++++++++++++++++++++++++++++++++++++++++++ No, not the three between President Barack Obama and Mitt Romney. +++++++++++++++++++++++++++++++++++++++++++++++++++++++++ I'm talking the two — Tuesday and Oct. 19 — between Texas U.S. Senate hopefuls Ted Cruz and Paul Sadler. They loom in importance for Sadler every bit as large as the presidential debates do for Romney, who is still trying to dig out from under his “47 percent” comments. +++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Texas math just isn't working out all that well for Sadler, the Democrat. +++++++++++++++++++++++++++++++++++++++++++++++++++++++++ There's the money. Cruz, a former Texas solicitor general, emerged from a GOP runoff against Lt. Gov. David Dewhurst having raised almost $9 million. He started his general election campaign with about $1.45 million in the bank. +++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Sadler — a former high-powered state legislator — ended his primary campaign with some $30,000 left in the bank, having raised $139,000. +++++++++++++++++++++++++++++++++++++++++++++++++++++++++ And it appears that the national Democratic Party is taking the attitude that there are wiser investments than in Texas, where one of their own hasn't won a statewide race in 18 years. +++++++++++++++++++++++++++++++++++++++++++++++++++++++++ The conventional wisdom is that Cruz can cruise from here to Nov. 6. Money is Sadler's best bet to upset that bit of wisdom. +++++++++++++++++++++++++++++++++++++++++++++++++++++++++ If he can't get over that high bar, his next best shot is to make big headlines thumping Cruz in these debates. But this also is a high bar. Not that Sadler is any slouch, but Cruz has made debate craft something of a life work. +++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Then there is an apparent enthusiasm gap. Some 1.1 million Texas Republicans voted in the Senate runoff, while only 235,000 Democrats did. +++++++++++++++++++++++++++++++++++++++++++++++++++++++++ This points to an early defeatist attitude among Texas Democrats that might be Sadler's highest bar. A strong showing for Obama in Texas could ameliorate this, but no one I know is predicting that Texas will show up in the blue column in November. +++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Sadler says he is working feverishly for the money. But at this point, he's in the fourth quarter, and team Cruz has the ball at first and goal. So, that leaves the debates and hopes for an interception or a fumble. This is where he sees an opening. +++++++++++++++++++++++++++++++++++++++++++++++++++++++++ “On the issues, I end up way ahead,” he says. +++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Yes, for a lot of folks, but, near as I can tell, Cruz's desire for diminutive government and his arch-conservatism have a history of being a fit for most red-state Texas voters. If Sadler changes this dynamic, it would represent a sea of change. +++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Nonetheless, he says the “stark contrast” between his views and Cruz's will spell the difference. And what gives this some merit is a presidential election that will decide between two similarly contrasting visions on government's role. +++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Sadler has slammed Cruz for only agreeing to two debates. I, too, would like to see more and wonder why Cruz rejected an offer for a third. But the truth is, he need not have even agreed to two. +++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Fueling Sadler's insistence on more face-to-face encounters and Cruz's desire to limit the debates: debates can manufacture threats where none existed. Frontrunners simply don't need them. +++++++++++++++++++++++++++++++++++++++++++++++++++++++++ I've been looking forward to the new fall season, but more for the debates than for “The Big Bang Theory.” +++++++++++++++++++++++++++++++++++++++++++++++++++++++++ The candidates do indeed offer stark contrasts. This should make for grand debate. In the past, such circumstances have resulted in the opposite. So... +++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Mr. Cruz: Tell me what it is about smaller government that is up to the challenges ahead. Get beyond the conservative bromides. +++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Mr. Sadler: In this race, you're Romney, who is discovering that it isn't enough to try to trash-talk the other guy. Kay Granger (R-Texas, pictured) said in a written statement Friday. "I am not convinced of the urgent need for this assistance and I cannot support it at this time," said Granger, who chairs the House Appropriations subcommittee on foreign operations. ++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++ U.S.-Egyptian relations have been unsettled since the overthrow in 2011 of the decades-long rule of Egyptian President Hosni Mubarak, a longtime U.S. ally. The incident occurred the same day an armed mob attacked the U.S. consulate in Benghazi, Libya, killing Ambassador J. Christopher Stevens and three staff members. The citing of the video as the spark that ignited the demonstrations in both countries has since been called into question, and Defense Secretary Leon Panetta said on Thursday that the attack in Libya was planned by terrorists. ++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++ "As we determined the details of what took place there and how that attack took place, it became clear that there were terrorists who had planned that attack," Panetta told reporters, adding that it "took awhile" to come to that conclusion. "I think that the investigation is ongoing [and] will hopefully determine that," the defense chief said. The United State remains committed to a transition to democracy in Cairo and believes continued American support for economic growth in that land will lead to peace and security, the official said. Last December, Congress made both economic and military aid to Egypt dependent on a determination by the United States that the government there is "supporting the transition to civilian government including holding free and fair elections; implementing policies to protect freedom of expression, association, and religion and due process of law." ++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++ The United States provides Egypt with $1.55 billion annually — $250 million in economic aid and $1.3 billion in military aid. Texas Congressman Ron Paul, a two-time candidate for the Republican presidential nomination, has long argued that the Constitution does not delegate to the U.S. government the authority to take money from the American people to give to governments and organizations in other lands. In an interview with Fox News on Monday, Paul argued that trying to influence governments and control events in far off land with grants of foreign aid rarely advances legitimate U.S interests and often results in turmoil and chaos rather than peace and stability. United States ++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Between 1993 and 2000, the Army Corps of Engineers purposely and repeatedly allowed floodwaters to escape the Clearwater lake and dam in southeast Missouri. Among the areas flooded by that water was the 23,000-acre Dave Donaldson Black River Wildlife Management Area in northeast Arkansas, which is managed by the Arkansas Game & Fish Commission. +++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Charging that its property had been irreparably damaged by the actions of the federal government, the Arkansas commission filed suit under the Fifth Amendment. The Court of Federal Claims weighed the evidence and agreed that a taking had indeed occurred. After observing that the government’s flooding had “so profoundly disrupted certain regions of the Management Area that the Commission could no longer use those regions for their intended purpose, i.e., providing habitat for wildlife and timber for harvest,” Judge Charles F. In fact, under the government’s theory of the case, “temporary” flooding can never trigger the Fifth Amendment. In an effort to illustrate the reach of the Takings Clause, the Court in pointed to its 1946 precedent in . In that case, the Supreme Court held that damage to a farmer’s livestock caused by repeated military overflights qualified as a taking under the Fifth Amendment. As the Court explained, “If, by reason of the frequency and altitude of the flights, respondents could not use this land for any purpose, their loss would be complete.” Indeed, continued, “it would be as complete as if the United States had entered upon the surface of the land and taken exclusive possession of it.” Loretto Loretto United States v.
